Driveway approaches, curb cuts and sidewalks in the City right-of-way

The concrete between your driveway and the street usually isn't on your lot. In Olathe it is City right-of-way, with its own permit, its own inspection, its own specifications and a guarantee the contractor has to stand behind for a year.

On most Olathe lots the property line sits a few feet behind the sidewalk, so the driveway approach, the curb cut and the sidewalk itself are in the public right-of-way the City owns and maintains. The City's Right-of-Way Permit Application and Specification Manual is clear about what that means: no work begins until the permit application has been approved. The permit costs $50 per adjacent parcel, fees double if work is done without one, the application can take up to 7 working days to review, and the permit is good for 60 days before it has to be re-approved. Where a curb cut or a street cut is involved, the City requires a $5,000 bond, and street cuts carry a separate fee based on the area disturbed. The Unified Development Ordinance adds a rule of its own: driveway entrances in the public right-of-way shall be constructed of concrete.

The City also inspects. Pre-placement inspections are required for pavement, curb and gutter, drive approaches and sidewalks, requested online at least 48 hours ahead, and the inspector checks the forms, the base and the reinforcement before any concrete goes in. Traffic and inspection staff get 48 hours' notice before construction, the concrete and asphalt tickets are emailed to the City within 24 hours of placement, and if we close your driveway you get 48 hours' written notice and a door hanger first. Excavations are backfilled within five working days, the surface is restored within three weeks, to a condition like or better than the original, and the contractor guarantees the work for one year from final acceptance.

That is a lot of paperwork for a 12-by-16-foot slab, and it is why we handle all of it: the application, the bond when one is needed, the inspection request, the notices, the tickets and the restoration, with the approach built to the City's technical specifications and the sidewalk at the cross-slope the ADA requires. If you have had a letter from the City about a sidewalk panel, bring it to the estimate. If you are adding a second approach or widening the curb cut, the UDO's access rules apply and we check them before we quote.

Questions we get about approaches and sidewalks

Who is responsible for the sidewalk in front of my house?

The sidewalk is in the City right-of-way, and any work on it needs the City's permit and inspection whoever pays for it. If the City has asked you to replace a panel, bring the letter and we will price exactly what it asks for, permit included.

Can I replace my approach myself?

Only with the City's permit, the pre-pour inspection and the bond where a curb cut is involved, and the work has to be restored to the City's specifications and guaranteed for a year. In practice that is a contractor's job.

How long does the City take?

The manual allows up to 7 working days to review an application, and the inspection needs 48 hours' notice. We submit early and schedule the pour after the permit is approved, not before.

Can I widen my curb cut or add a second driveway?

Sometimes. The UDO's access-management rules set widths and spacing, and a second approach on a corner or a busy street is not automatic. We check the rules for your street before we promise anything.

What if the sidewalk is heaved by a tree?

If the tree is in the right-of-way, the City decides what happens to it; if it is yours, the roots are usually trimmed back and the new panel is poured over a deeper base so it has somewhere to go. Either way the replacement needs the permit.
